A recent book about Agricola's conquest of Scotland presents a Scottish historian's take on a subject that has been dominated by archaeologists: the whereabouts of Mons Graupius, the scene of Agricola's final battle. Unfortunately, in confidently locating it in Perthshire, author James Fraser builds his case on shaky foundations.

This article examines the changing scope and method of ecumenical public theology from the World Missionary Conference of 1910 until the present. Most changes were made in response to the changing ideological and political contexts. The collapse of liberalism and the social gospel was followed by a type of confessional ethics which arose directly out of the German Church Struggle. In opposition to this there emerged a realist ecumenical social ethics, much indebted to Reinhold Niebuhr, and of Ronald Preston. This (...) type of public theology and its distinctive ‘middle axiom’ method are examined and contrasted with the more recent public theologies which were influenced by liberation theology and grassroots movements. It is suggested that the ending of the Cold War and the fundamental changes that have taken place since September 11 2001 present a radically new kind of challenge to public theology. (shrink)

First published in 1894, this book consists of essays by professors Jowett and Campbell about the classic Greek philosopher Plato, and his famous and widely read dialogue The Republic, which is considered one the world's most influential works. Plato is believed to be the pivotal figure in the development of Western philosophy, and the editors explore this throughout the book along with relations to other Greek dialogues and authors.

Election interference is one of the most widely discussed international phenomena of the last five years. Russian covert interference in the 2016 U.S. Presidential Election elevated the topic into a national priority, but that experience was far from an isolated one. Evidence of election interference by foreign states or their proxies has become a regular feature of national elections and is likely to get worse in the near future. Information and communication technologies afford those who would interfere with new tools (...) that can operate in ways previously unimaginable: Twitter bots, Facebook advertisements, closed social media platforms, algorithms that prioritize extreme views, disinformation, misinformation, and malware that steals secret campaign communications. Defending Democracies examines the problem through an interdisciplinary lens and focuses on: defining the problem of foreign election interference, exploring the solutions that international law might bring to bear, and considering alternative regulatory frameworks for understanding and addressing the problem. The result is a deeply urgent examination of an old problem on social media steroids, one that implicates the most central institution of liberal democracy: elections. The volume seeks to bring domestic and international perspectives on elections and election law into conversation with other disciplinary frameworks, escaping the typical biases of lawyers who prefer international legal solutions for issues of international relations. Taken together, the chapters in this volume represent a more faithful representation of the broad array of solutions that might be deployed, including international and domestic, legal and extra-legal, ambitious and cautious. This essay explores the ethical and legal implications of prioritizing the militarization of cyberspace as part of a roundtable on “Competing Visions for Cyberspace.” Our essay uses an ideal type—a world that accepts warfighting as the prime directive for the construction and use of cyberspace—and examines the ethical and legal consequences that follow for who will have authority to regulate cyberspace; what vehicles they will most likely use to do so; and what the rules of behavior for states and stakeholders (...) will be. We envision a world where states would take on a greater role in governance but remain constrained by law, includingjus ad bellumandjus in bellocriteria, but also sovereignty, nonintervention, and self-determination. We ask if the net result would mean states causing less harm than they do in kinetic conflicts. Ultimately, our essay takes no position on whether cyberspace should be a militarized domain. Rather, our goal is to situate a warfighting cyber domain within the reality of a pluralist cyberspace, where ethical imperatives compete or coalesce to support specific governance mechanisms. More than 6% of babies are born with a structural or functional defect, and many of these need special care and treatment to survive and thrive. Such defects can be inherited, arise through exposure to altered conditions or compounds in the womb, or result from a combination of genetic and environmental factors. Since the 1940s, animal experiments and epidemiological studies have identified many environmental factors that can cause particular birth defects. More recently, advances in genomics have allowed a simple genetic (...) diagnosis in ∼ 30% of birth defects. However, the cause of the remainder is a mystery. I believe that a key limiter to successful identification of new environmental factors is that clinicians, epidemiologists and developmental biologists all approach the topic from different angles. I propose that better communication between such experts will further increase our understanding of the environmental causes of birth defects, and potentially reduce their global burden. (shrink)

Christian thought on the resolution of conflicts rests on a strong predisposition against violence and a determination to discourage outbreaks of violence, limit the means used, and bring the conflict to as speedy an end as possible. Less attention has been given to the psychological and social roots of violence, the moments of transition from violence to diplomacy and reconciliation, and alternative ways of conflict resolution. These three areas are explored with special reference to the use of sanctions, the WCC’s (...) Programme to Overcome Violence, the Truth and Reconciliation Commission in South Africa, Gandhian Satyagraha, and the Northern Ireland Peace Process. Such measures should be judged against the same criteria as are used in relation to violence and war. (shrink)

An experimenting society is one in which policy-relevant knowledge is created. It is then critically assessed and communicated in real-life or natural settings, with the aim of discovering new forms of public action to improve the problem-solving capacities of society. This latest volume of the distinguished Policy Studies Review Annual series probes, evaluates, and augments the work of Donald T. Campbell on an experimental societies. A basic assumption of this volume is that Campbell's perspective supplies a useful way (...) to address increasingly complex and seemingly unmanageable problems facing the United States and other postindustrial societies. This volume is also the fourteenth festschrift to be issued by Transaction. The focus is on theoretical as well as practical options for creating an experimenting society. The rationale for this focus is the belief, increasingly -shared in the social science and policy-making communities alike, that researchers are essentially ignorant about how to solve many of the most pressing larger problems of this epoch. This frank recognition of ignorance is a prerequisite of genuine scientific and professional curiosity, without which knowledge gains are next to impossible to achieve, and a'precondition of an experimenting society. The United States Supreme Court's decision in Bell Atlantic Corp. v. Twombly is creating quite a stir. Suddenly gone is the famous loosey-goosey rule of Conley v. Gibson that a complaint should not be dismissed for failure to state a claim unless it appears beyond doubt that the plaintiff can prove no set of facts in support of his claim which would entitle him to relief.Now a complaint must provide enough facts to state a claim to relief that is plausible (...) on its face. Only decided last May, Bell Atlantic has been cited in over 3,700 cases. Already being described as a landmark decision, Bell Atlantic nonetheless has lawyers and judges scratching their heads over the precise pleading standard to apply in its wake. As the Second Circuit (mildly) put it, Considerable uncertainty concerning the standard for assessing the adequacy of pleadings has recently been created by the Supreme Court's decision in Bell Atlantic Corp. v. Twombly. Just what is a plausible showing that the pleader is entitled to relief under Rule 8(a)(2)?I believe an answer lies in the 26-year-old decision of the Former Fifth Circuit in In re Plywood Antitrust Litigation. Plywood Antitrust requires, at a minimum, that a complaint . . . contain either direct or inferential allegations respecting all the material elements necessary to sustain a recovery under some viable legal theory. Already used in more than half the circuits, this standard paraphrases advice found in the venerable WRIGHT & MILLER for nearly 40 years.Properly applied, this all . . . material elements standard satisfies Bell Atlantic's plausibility requirement in all respects. The Plywood Antitrust pleading standard works well after Bell Atlantic, first, because the Supreme Court referred to the standard, albeit parenthetically, with approval in Bell Atlantic. Second, it does much to harmonize the Federal Rules' goal of dispensing with pleading technicalities while still requiring enough general factual information about a pleader's claim to make the notice in notice pleading meaningful. Finally, and perhaps most importantly, it gives lawyers, litigants, and courts a standard they can actually use when drafting, or assessing the sufficiency of, pleadings. (shrink)

The human major histocompatibility complex (MHC), on the short arm of chromosome 6, represents one of the most extensively characterised regions of the human genome. This ∼4 Mb segment of DNA contains genes encoding the polymorphic MHC class I and class II molecules which are involved in antigen presentation during an immune response. Recently the whole of the MHC has been cloned in cosmids and/or yeast artificial chromosomes (YACs) and large portions have been characterised for the presence of novel genes. (...) Many unrelated genes, both housekeeping and tissue specific, have been identified and the gene density in some regions is now approaching one gene every few kilobases. Some of the novel genes encode proteins involved in the intracellular processing and transport of antigens that are presented by MHC class I molecules. Others, however, have no obvious role in the immune response. The MHC is located in the chromosome band 6p21.3 which is a Giemsa (G)‐light band. The detection of such a large number of functional genes (at least 70) in this region is compatible with the idea that both housekeeping and tissue‐specific genes are localised predominantly in G‐light bands. Variant Creutzfeldt–Jakob disease is a fatal, transmissible, neurodegenerative disorder for which there is currently no effective treatment. vCJD arose from the zoonotic spread of bovine spongiform encephalopathy. There is now compelling evidence for human to human transmission through blood transfusions from presymptomatic carriers and experts are warning that the real epidemic may be yet to come. Imperatives exist for the development of reliable, non-invasive presymptomatic diagnostic tests. Research into such tests is well advanced. In this article the ethical implications of (...) the availability of these tests are elaborated and comparisons drawn with predictive genetic testing for Huntington’s disease and screening for HIV. Paramount to considerations is the issue of whom to test, weighing up respect for personal autonomy against obligations to benefit and protect society. A paradigm is proposed similar to that used for HIV screening but with unique features: compulsory testing of all blood/organ donors and individuals undergoing surgery or invasive procedures who have a significant risk of disease transmission. In the United Kingdom there have been few committees or commissions dealing specifically with biomedical ethics, and where such bodies have been set up they have merely reported on a specific topic and then disbanded. However, there may well be standing committees in the future, of which the Voluntary Licensing Authority for Human In Vitro Fertilisation and Embryology is a precursor. This paper surveys the work of three special committees or working groups which have reported in the period 1970 to (...) the present. Of these the Warnock Committee is by far the most important, and the issues which it raises are discussed with specific reference to the place of philosophers and theologians on such bodies. It is concluded that, although there has been some movement in the UK toward the utilization of those with special skills and knowledge in the field of bioethics, much more could be done in this regard. Medical-legal partnerships — collaborative endeavors between health care clinicians and lawyers to more effectively address issues impacting health care — have proliferated over the past decade. The goal of this interdisciplinary approach is to improve the health outcomes and quality of life of patients and families, recognizing the many non-medical influences on health care and thus the value of an interdisciplinary team to enhance health. There are currently over 180 MLPs at over 200 hospitals and health centers in the United (...) States, with increasing federal interest and potential legislative support of this model.This article examines the unique, interrelated, and often similar ethical issues that confront the clinical and legal partners involved in MLPs. We contend that the ethical precepts of the clinical and legal professions should be seen as opportunities, not barriers, to further the interdisciplinary nature of MLPs. (shrink)

The concept of selecting for a disability, and deafness in particular, has triggered a controversial and sometimes acrimonious debate between key stakeholders. Previous studies have concentrated on the views of the deaf and hard of hearing, health professionals and ethicists towards reproductive selection for deafness. This study, however, is the first of its kind examining the views of hearing children of deaf adults towards preimplantation genetic diagnosis and prenatal diagnosis to select for or against deafness. Hearing children of deaf adults (...) straddle both the deaf and hearing worlds, and this dual perspective makes them ideally placed to add to the academic discourse concerning the use of genetic selection for or against deafness. The study incorporated two complementary stages, using initial, semistructured interviews with key informants as a means to guide the subsequent development of an electronic survey, completed anonymously by 66 individuals. The participants shared many of the same views as deaf individuals in the D/deaf community. The similarities extended to their opinions regarding deafness not being a disability, their ambivalence towards having hearing or deaf children and their general disapproval of the use of genetic technologies to select either for or against deafness.
